Temporary Orders

Temporary Orders can include Temporary Spousal Support and other issues, including a possible award for your Attorney's Fees. These orders only govern issues during your divorce matter. They do not continue after the case is concluded. You and your spouse must abide by these Temporary Orders or face Contempt of Court charges.

Just a few examples of the issues that may be addressed include:
  1. Who will live in the marital residence and who will move out?
  2. Will the marital residence be listed for sale? If so, under what conditions?
  3. How will the available cash be divided?
  4. Who will run a commonly owned business?
  5. Who will control the investment interests?
  6. What financial and logistical arrangements will be made for Child Related Issues?
  7. How will my credit be protected during the divorce proceedings?
There are two methods in which the court issues Temporary Orders. The first, and preferable method, is by stipulation. This means that the Las Vegas divorce attorneys representing each spouse have obtained an agreement acceptable to both parties. This agreement is then entered into the court's record. Unfortunately, most Temporary Orders are not by stipulation.

The second method requires the drafting of a Motion for Temporary Orders and a court hearing. The Las Vegas divorce attorneys representing you and your spouse will first submit their written pleadings to the Family Court Judge assigned to your case. They will then appear before the judge at a court hearing. Each attorney will provide the judge with the legal arguments and logistical reasons supporting why their client's wishes should be granted. The judge will then make a determination on all issues before the court.
